1. Agreement to Terms:

By using OnComms services, you agree to be bound by these Terms and Conditions and any applicable policies, such as our Privacy Policy. This agreement constitutes a binding contract between you and OnComms. If you do not agree with these terms, you must stop using our services.

2. Service Provision:

OnComms provides wireless telecommunication services. All services are subject to the availability of networks, including but not limited to any technical, geographic, or environmental limitations. We reserve the right to modify, suspend, or discontinue our services without prior notice, and you agree that we are not liable to you or any third party for such modifications, suspensions, or discontinuations.

3. User Responsibilities:

You are responsible for keeping your account details, including passwords, secure. You are responsible for ensuring that your use of OnComms services complies with all applicable laws and regulations. You are responsible for ensuring that the device(s) you use comply with network standards.

4. Billing and Payments:

All services are provided on a pre-paid or post-paid basis as outlined in your service agreement. You agree to pay all applicable charges for the services provided, including taxes, fees, and other surcharges.

5. Data Usage and Analytics:

By using our services, you agree that OnComms can collect, analyze, and store data regarding your usage patterns to improve our services and provide customized offers to you. This includes, but is not limited to, call data, browsing data, and usage metrics. You also consent to our sharing of anonymized data with affiliates and partners for analytical and product enhancement purposes.

6. Sharing Data with Affiliates:

You consent to OnComms sharing your data with its affiliates or sister companies to provide additional services or products. This may include sharing information about your preferences, service usage, and other data for marketing purposes or to improve services. You can withdraw this consent at any time by contacting our support team, but doing so may affect the availability of certain services.

7. Lost or Stolen Devices:

You agree to notify us immediately if your device is lost or stolen. Once notified, we will suspend your service to prevent further charges. You are not responsible for any usage charges incurred after your device is reported as lost or stolen. If you choose not to suspend service, you remain responsible for all charges and fees incurred. We may block the lost or stolen device from registering on our network or other networks. California customers: You are not liable for unauthorized charges before notifying us, but the use of your device is considered evidence of authorization. You may request an investigation of unauthorized charges, and if we determine they were unauthorized, we will credit your account.

8. Misuse of Service or Device:

By using OnComms services, you agree that they are solely for personal use, including voice calls, text messages, and internet browsing. You must not misuse the service or device, including:

1) Reselling or rebilling the service.

2) Engaging in unlawful activities or interfering with our network.

3) Using the service for continuous, mobile-to-mobile or landline calls, automated messaging, or excessive data usage.

4) Tampering with your device, engaging in spamming, or using the service for mass communication.

5) Running software that maintains continuously active internet connections or using the service to relay calls not originating from the device.

Violations of these restrictions may result in suspension or termination of service.

9. Dispute Resolution:

Any disputes arising from your use of OnComms services will be resolved through binding arbitration. Both parties waive the right to a jury trial. You must attempt to resolve disputes through our customer service within 60 days of reporting the issue.

10. Emergency and 9-1-1 Services:

In emergencies, you are responsible for providing location details when calling 9-1-1, as this information may not be automatically transmitted. OnComms does not guarantee uninterrupted access to emergency services, especially during network outages.

11. Charges and Billing:

You agree to pay all charges, fees, and taxes associated with your OnComms service. If you opt for automatic renewal, your service will continue unless you cancel. Billing disputes must be reported within 30 days of the disputed charge.

12. Data Usage and Restrictions:

Data plans are for personal use only. OnComms may reduce speeds or suspend service for excessive usage, tethering, or non-compliant usage, such as continuous streaming or automated data transmissions.

13. Termination and Cancellation:

You may cancel your service at any time. OnComms may terminate or suspend your account for any violations of these terms or excessive data usage. No refunds will be issued for unused services unless specified in promotions.

14. Fees and Government Charges:

Recovery Fee
OnComms may charge a Recovery Fee in addition to your service plan. This fee does not equate to additional service time and may be subject to change without notice.

Federal Universal Service Fund Fee
This fee supports OnComms' contributions to the Universal Service Fund. The rate may vary based on FCC regulations and USAC contributions.

Federal Regulatory Recovery Charge
This fee covers regulatory costs, including Telecommunications Relay Services (TRS) for customers with disabilities and number portability.

Other Government Fees
State and local fees, including the State Universal Service Fund Fee and Local 9-1-1 fees, are calculated based on your billing address. These charges may appear as recurring fees on your account.

Government Taxes
Federal, state, and local taxes will be calculated based on the billing address on file. If no valid address is provided, OnComms may assign a default ZIP code, which is 32246 (Jacksonville Fl), for tax purposes.

15. Right to Dispute Charges:

Dispute Process
If you wish to dispute any charges on your bill, you must notify OnComms within 60 days (20 days for Puerto Rico customers) in writing. If not, you may lose the right to arbitration or court claims. You must pay the disputed charges while they are being resolved.

Puerto Rico Customers
Puerto Rico customers may appeal OnComms' determination of a dispute to the Telecommunications Board of the Commonwealth of Puerto Rico within 30 days.

16. Device Warranty Information:
All new devices purchased from OnComms are covered by a one-year manufacturer’s warranty. Refurbished devices come with a 60-day warranty. To claim a warranty replacement, follow the instructions listed under Section 15. Your defective device must be returned in good condition. Devices damaged due to liquid exposure or unauthorized modifications (e.g., ‘modded’ OS) are not covered and will be returned without a refund or repair. You are responsible for backing up your data, as lost data is not recoverable.

OnComms is not liable for:
1) Consequential damages (loss of use, revenue, or data).

2) Loss of time or interruption of service.

3) Restoring lost data. The only warranties applicable are those provided by the manufacturer. OnComms disclaims any implied warranties, including those of merchantability and fitness for a particular purpose.

17. Refunds for Canceled Service:
OnComms may issue refunds for service cancellation based on specific conditions. Refunds will only be provided for any remaining service period that has been prepaid. If your service is canceled mid-month or mid-period, you may be eligible for a prorated refund, minus any applicable fees. Refunds are not guaranteed for services that have been used beyond the initial period. Prepaid services and promotional plans may be non-refundable, as outlined at the time of purchase. 18. Customer Communications:

Notices and Consent
By using OnComms services, you agree to receive communications via email, text, or other electronic means. Notices are considered delivered upon receipt by your device or three days after mailing.

Autodialed or Prerecorded Messages
OnComms may contact you using autodialed or prerecorded messages for account or marketing purposes. You may be charged based on your service plan.

Revocation of Consent
You may opt-out of receiving autodialed or prerecorded messages by contacting OnComms customer support or adjusting your preferences on our website.

19. Our Rights to Limit or End Service:
OnComms reserves the right to limit, throttle, suspend, or terminate your service without notice if you breach these terms, misuse your service or device, or if your service becomes unprofitable for OnComms. We may also limit data throughput and block specific types of calls or messages. If we terminate your service and later reinstate it, you may be charged a reinstatement fee.

20. Limitation of Liability:
OnComms is not liable for indirect, incidental, or consequential damages resulting from your use of our services. The total liability for any claim related to your use of our services is limited to the amount paid by you for the specific service in question.

21. Intellectual Property:
You agree not to infringe upon or violate the intellectual property rights of OnComms or any third party. By using OnComms services or devices, you are granted a limited license for personal use. You may not copy, modify, or resell OnComms intellectual property without explicit authorization.

22. Privacy Information:
OnComms' Privacy Policy governs how your personal information is collected and used. We reserve the right to modify the Privacy Policy without notice. We encourage regular backups of your data, as OnComms is not responsible for data stored on your SIM, eSIM, or Devices.
